

REFERRAL SCHEME T&Cs & FAQs
At SWBM ACADEMY, we offer a referral program that provides our registered members the opportunity to earn rewards by referring new individual customers or organisations to our academy. These Terms and Conditions outline the guidelines, rewards, and responsibilities associated with participation in the referral program.
The SWBM ACADEMY Referral Program is open to all individuals who are registered with SWBM ACADEMY. Participation is contingent upon agreeing to these Terms and Conditions.
A 'Referral' occurs when:
An individual ('Referee') makes an online purchase from the SWBM ACADEMY website using a unique referral number (URN) provided by an existing customer ('Referrer').
A referred organisation submits a Referrer’s URN confirming their referral by the Referrer.
Referrers act independently and are not considered employees, agents, officers, workers, or partners of SWBM ACADEMY. They should not represent themselves as such.
Referrers are solely responsible for any taxes and National Insurance contributions that arise from rewards received through this program.
Referrers may contact potential referees or organisations but must not misrepresent themselves as employees, agents, officers, workers, or partners of SWBM ACADEMY.
Referrers receive specified rewards for each valid referral when the Referee uses the URN at the time of their first purchase (unless corporate clients are referred, please see below). Failure to use the URN results in forfeiture of the reward unless the referral is subsequently confirmed by the Referee.
Rewards are not applicable for referring existing SWBM ACADEMY customers. Referees must be new to SWBM ACADEMY.
Rewards are confirmed and communicated via email within five working days after the completion of a purchase and any required courses by the Referee.
SWBM ACADEMY reserves the right to adjust the reward structure at any time without prior notice.
The commission for referring individual customers is tiered as follows:
Tier 1: 10% commission on sales up to £1000 in a month.
Tier 2: 15% commission on sales between £1001 and £2000 in a month.
Tier 3: 20% commission on sales between £2001 and £4000 in a month.
Tier 4: 25% commission on sales exceeding £4001 in a month.
Payments are made monthly on the 10th of the following month.
11:1 Commission Structure
Description: When you refer an entire organisation to us, your account will be linked to this organisation, and commissions will be paid based on total sales made by the referred organisation.
Group Bookings: For a group booking (minimum of 12 people) from the referred organisation, you will receive 25% of the total sales from the first booking and a 10% ongoing commission thereafter for the duration of our relationship with the organisation.
Individual Bookings: If the referred organisation makes individual bookings, your commission structure will mirror the individual four-tier system for the duration of our relationship with the organisation – Tier 1 and/or 2 will be applicable to this option.
11:2 Definition of Active Participation
Active participation can be defined as demonstrating ongoing engagement with the sales process and consistent efforts to generate and close sales. This could include regular interactions with potential and existing clients, and achieving regular sales.
11:2:1 Proposed Terms for Active Participation
11:2:1:1 Active Status Maintenance:
Sales Activity: To maintain an active status, a salesperson must register at least one new sale or secure a minimum revenue of £1000 every three months. This ensures continuous engagement and contribution to the company's objectives.
Check-Ins: Regular check-ins via email or digital meetings might be required to discuss progress, challenges, and strategies. This keeps the communication lines open and provides support where needed.
11:2:1:2 Loyalty Incentives
Annual Bonuses: 10% Loyalty bonuses are awarded annually to salespeople who exceed their sales targets by at least 20%. Calculated only on the excess amount.
High-Value Sales Commission: An additional 10% commission will be granted on all annual sales revenue that exceeds £100k, calculated only on the excess amount.
11:2:1:3 Transition to Inactive Status:
Inactivity Criteria: If no sales activity is recorded within a three-month period, their status will transition to inactive.
Commission Adjustments: Once deemed inactive, the salesperson / referrer will receive a notification, and their ongoing commissions from previous sales will be adjusted to 50% of the active rate. For instance, if a 10% commission was earned while active, this will reduce to 5% upon transitioning to inactive status.
Duration of Post-Inactive Commissions: Inactive salespeople / referrer will continue to receive commissions from previously secured accounts for a period of up to 12 months after becoming inactive.
11:2:1:4 Reactivation Process:
Inactive salespeople / referrer can reactivate their status by achieving new sales or by demonstrating renewed sales efforts that meet predefined thresholds.
Upon reactivation, the salesperson / referrer will once again be eligible for full commission rates and benefits from new sales generated by the salesperson.
11:2:1:5 Communication of Status Changes:
Clear communication will be provided regarding status changes. Salespeople / referrers will be notified in advance of impending status changes and upon official transition to inactive status.
Guidance on how to reactivate or appeal decisions will also be included in these communications.
Participation also subjects the Referrer to the general terms and conditions of the SWBM ACADEMY website, which cover additional aspects like privacy and security.
SWBM ACADEMY collects and processes participants' personal data for the purposes of managing the referral program, including registration, sale tracking, and reward notification.
SWBM ACADEMY reserves the right to close the accounts of Referring or Referred Customers if they have been involved in fraudulent activities that violate these terms or any applicable laws. SWBM ACADEMY is not liable for lost, delayed, damaged, or misdirected referrals or communications, or for any website failures, problems, or technical malfunctions of any computer online systems, servers, access providers, computer equipment, software, or for the failure of any email or referral to be received by SWBM ACADEMY due to technical problems, internet traffic congestion, or any combination thereof, including any injury or damage to your (or any other person's) computer related to or resulting from participation in this programme. SWBM ACADEMY reserves the right, at its sole discretion, to modify, cancel, or suspend this programme in the event of a virus, bug, or other causes beyond the reasonable control of SWBM ACADEMY that corrupt the security or proper administration of the programme or for any other reason.Top of Form
Referrals are subject to verification and will be deemed invalid if they are illegible, unintelligible, falsified, altered, tampered with, or unlawful in any manner. Referrals made through unauthorized means will be disqualified. If it is determined that a referral was made in a manner not approved by these terms, both you and all your referrals will be disqualified from the program, and any awarded referral credits will be revoked. By participating, you agree to comply with the terms of this program and accept the final decisions made by the SWBM ACADEMY team. This program is governed by all relevant laws and regulations.
SWBM ACADEMY reserves the right to modify, terminate, cancel, or suspend this program at its discretion – e.g. in cases of breach of these terms, code of conduct or other legal issues, etc.
Any disputes related to commissions will be handled through a formal dispute resolution process.
Referrer are required to submit detailed sales reports and any relevant client contracts as proof of sale to claim commissions. These documents must be provided within 30 days of the dispute.
The company reserves the right to amend these terms with 30 days' notice to all affected sales personnel.
By participating in the referral program, participants agree to abide by these Terms and Conditions and accept decisions made by SWBM ACADEMY regarding the program.
